Terms of Service

These terms govern your use of Food Cafe, the QR ordering, kitchen display, billing and restaurant management platform at foodcafeshop.in and its sub-domains. By using Food Cafe you agree to them. Section 3 applies to diners; section 4 applies to restaurants that sign up ("restaurant partners").

1. What Food Cafe is

Food Cafe is a technology platform. Restaurants use it to show menus, take orders and manage their operations. Food Cafe does not prepare, sell or deliver food. When you order, your contract for food and service is with the restaurant, which is responsible for its menu, prices, taxes, food quality, hygiene, allergen information and delivery.

2. Your account and conduct

• Give accurate information and keep your login details safe.
• Do not place fake or prank orders, misuse table or takeaway OTPs, or order for a table you are not at.
• Do not try to access other restaurants' data, bypass plan limits, probe for vulnerabilities, or overload the service.
• Do not post reviews that are false, abusive, or infringe someone else's rights.

We may suspend access that breaks these rules or the law.

3. For diners

• Prices, taxes, service charges and packaging or delivery charges are set by the restaurant and shown before you order.
• An order is accepted when the restaurant accepts it. The restaurant may decline or cancel orders, for example when an item is unavailable.
• You pay the restaurant directly. Questions about food, bills or refunds for food go to the restaurant; we will help put you in touch.
• By posting a review you allow us and the restaurant to display it on Food Cafe.

4. For restaurant partners

Your responsibilities

• You must hold the licences your business needs (including FSSAI) and keep menus, prices, taxes and allergen information accurate.
• You are responsible for your staff accounts and everything done through them.
• You control the customer data you collect through Food Cafe and must use it lawfully.
• You own your menus, photos and business data. You give us a licence to host and display them to run the service.

Plans and fees

• The Free plan is free, with the limits shown on the subscription page. Paid plans unlock higher limits and more features.
• Prices are in Indian Rupees and exclude GST unless stated. Fees are billed in advance for each billing period.
• We may change plan prices or limits with at least 30 days' notice. Changes apply from your next billing period.
• If a payment fails or a paid period ends without renewal, your account moves to the Free plan's limits. Your data is kept.

Cancellation and refunds

• You can cancel a paid plan at any time by contacting us. Cancellation takes effect at the end of the current billing period, and you keep paid features until then.
• Fees already paid are not refundable for partial periods or unused features, except as required by law.
• Duplicate or wrong charges are refunded in full to the original payment method within 7 business days of being confirmed.
• If we end your paid plan for reasons other than a breach of these terms, we refund the unused part of the current period.

5. Availability and changes

We work to keep Food Cafe available, including offline ordering when the internet drops, but we do not guarantee uninterrupted or error-free service. We may add, change or remove features, and will give reasonable notice before removing a feature included in your paid plan.

6. Our intellectual property

The Food Cafe software, design and brand belong to us. You may not copy, resell or reverse-engineer them.

7. Liability

Food Cafe is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits or lost business, or for the food and service provided by restaurants. Our total liability to a restaurant partner for any claim is limited to the fees it paid us in the 3 months before the claim. Nothing here limits liability that cannot be limited by law.

8. Ending use

You may stop using Food Cafe at any time. We may suspend or close accounts that breach these terms, fail to pay, or put other users or the service at risk. Sections 6, 7 and 9 continue after an account ends.

9. Governing law

These terms are governed by the laws of India. Courts at Patna, Bihar have exclusive jurisdiction, subject to any consumer rights you have under Indian law.
